whether negligence of owner-cum-driver plays a key role in settlement of own damage claim under commercial vehicle insurance policy or not ? please guide me.

Of course it does! If the damage is done out of sheer negligence then the claim is not settled completely. Only the third party damages are settled and the self damage extent depends on the underwriters discretion.
